En este trabajo se analizan las cláusulas de liquidez constitucional (CLC), tal como han sido caracterizadas por José María Sauca. Sobre los rasgos estructurales, se sostiene, primero, que es difícil reconducir los ejemplos de CLC a un solo modelo, por cuanto, una vez introducida la distinción entre reglas prescriptivas y constitutivas, caben seis posibles reconstrucciones; segundo, que el principio de prevalencia, lejos de suponer que no hay contradicciones entre las normas que puedan emanar de las CLC y la normativa (...) constitucional, las presuponen; tercero, que mantener que las CLC implican una transferencia de soberanía solo puede obedecer a un uso ambiguo del término “soberanía”. Por lo que hace a las funciones, y en contra de lo sostenido por Sauca, se muestra que las CLC pueden conducir a mutaciones constitucionales y es factible considerarlas mecanismos de última palabra. The book documents thirty cases in which university-trained scholars were condemned for disseminating allegedly erroneous opinions in their teaching or writing.

The purpose of this qualitative study was to examine the perceptions related to ethics and cheating among a representative sample of primarily female undergraduate students, compared to trends reported in the literature. Focus groups were organized to discuss nine scripted questions. Transcripts and audiotapes were analyzed and four main themes emerged: demographics of those who cheat, students’ perceptions of cheating, the role of technology in cheating, and consequences of cheating, including students’ attitudes and behaviors related to reporting cheating incidents. Bandura’s (...) Social Cognitive Theory served as the theoretical framework to understand students’ varying perceptions of and justification for cheating, as well as the dynamics of honor code violations, via group discussion. Viewpoints on cheating were regularly discussed and contradictory views were identified related to frequency and justification for cheating. Utilizing the constant comparative method, students mentioned time limitations, and pressure from peers, parents, and professors as reasons to cheat. They also discussed pressures to achieve high grades for acceptance into graduate programs. Students were also reluctant to report their classmates for cheating incidents. Repeated and comprehensive education on ethical behavior is warranted. (shrink)

Professor Bartha Maria Knoppers stepped down from the Canada Research Chair in Law and Medicine at McGill University in April 2024, a post she held for more than 20 years. Professor Knoppers consistently prioritized "humanity" in her academic work and in policymaking. As such, she forged a strong intellectual legacy, notably through her work on the human right to science, genomic and health-related data sharing, genome editing, human reproductive technologies, stem cell research, the rights of children, and population health. Combining the liberalism of Locke and the "civic humanism" of Republicanism, Mary Wollstonecraft explored the need of women for coed and equal education with men, economic independence whether married or not, and representation as citizens in the halls of government. In doing so, she foreshadowed and surpassed her much better known successor, John Stuart Mill. Ten feminist scholars prominent in the fields of political philosophy, constitutional and international law, rhetoric, literature, and psychology argue here that Wollstonecraft, by reason of the (...) scope and complexity of her thought, belongs in the "canon" of political philosophers along with Rousseau and Burke, her contemporaries, both of whom she strenuously engaged in political debate. These essays explore the many aspects of her thought that resound so tellingly to the modern woman, including her groundbreaking attempt to be completely self-sufficient. The final bibliographical essay outlines the changing interpretations of Wollstonecraft's work over the past two hundred years and evaluates her standing among political theorists today. This paper deals with Ramsey's theory of truth and its aim is twofold: on the one hand, it will explain what position about truth Ramsey actually defended, and, on the other hand, we will pursue Ramsey's insight in the 20th Century. When the name of Frank Ramsey is mentioned, one of the things that comes to mind is the theory of truth as redundancy. In the following pages we will argue that Ramsey never supported such a theory, but rather an (...) analysis of truth noticeably similar to the prosentential account. In fact, the very word "pro-sentence" appears for the first time in the 20th Century in Ramsey's unfinished work "The nature of truth," written around 1929. Besides, we will show that the prosentential account of truth is a neglected trend throughout the history of analytic philosophy, even though relevant analytic philosophers, such as Prior, Strawson, Williams, Grover, and Brandom, have endorsed it. Las presentes páginas se proponen abordar el concepto kierkegaardiano del instante (Oeieblikket) a la luz de algunas nociones históricas, ganadas por Soeren Kierkegaard a favor del existente singular. En efecto, tanto el pensamiento antiguo, como el cristiano y el moderno habrían contribuido a la idea de un instante personal, que niega y conserva en la eternidad la totalidad de la historia.

Durante más de 3000 años, las religiones patriarcales han simbolizado un sistema socio-político e ideológico, que dominó hasta hoy la historia universal. Sin embargo, desde hace por lo menos dos siglos, el pensamiento y la cultura vienen anunciando la muerte del Dios Padre e indagando el destino de la humanidad futura. El presente trabajo intentará mostrar por qué la Gran Diosa Madre simboliza el Otro Nombre, en el cual la subjetividad y la cultura han comenzado a pronunciarse.

Relativism, roughly put, is the view that truth and falsity, right and wrong, standards of reasoning, and procedures of justification are products of differing conventions and frameworks of assessment and that their authority is confined to the context giving rise to them. More precisely, ‘relativism’ covers views which maintain that—at a level of high abstraction—at least some class of things have properties they have not simpliciter, but only relative to a given framework of assessment, and correspondingly, that the truth of (...) claims attributing these properties holds only once the relevant framework of assessment is specified or supplied. Relativists characteristically insist, furthermore, that if something is only relatively so, then there can be no framework-independent vantage point from which the matter of whether the thing in question is so can be established. Relativism has been, in its various guises, both one of the most popular and most reviled philosophical doctrines of our time. Defenders see it as a harbinger of tolerance and the only ethical and epistemic stance worthy of the open-minded and tolerant. Detractors dismiss it for its alleged incoherence and uncritical intellectual permissiveness. Debates about relativism permeate the whole spectrum of philosophical sub-disciplines. From ethics to epistemology, science to religion, political theory to ontology, theories of meaning and even logic, philosophy has felt the need to respond to this heady and seemingly subversive idea. Discussions of relativism often also invoke considerations relevant to the very nature and methodology of philosophy and to the division between the so-called ‘analytic and continental’ camps in philosophy. And yet, despite a long history of debate going back to Plato and a still developing large body of writing, it is still difficult to come to an agreed definition of what, at its core, relativism is, and what philosophical import it has. Recently, there has been a convergence of fields studying the processing of DNA, such as transcription, replication, and repair. This convergence has been centered around the packaging of DNA in chromatin. Chromatin structure affects all aspects of DNA processing because it modulates access of proteins to DNA. Therefore, a central theme has become the mechanism(s) for accessing DNA in chromatin. It seems likely that mechanisms involved in one of these processes may also be used in others. For example, the discovery (...) of transcriptional coactivators with histone acetyltransferase activity and chromatin remodeling complexes has provided possible mechanisms required for efficient repair of DNA in chromatin. El segundo está relacionado con la posición particular que Puntel defiende y en concreto con su crítica a las (...) teorías pro-oracionales. El primer asunto tiene relevancia porque las cuestiones preliminares en teoría de la verdad constriñen el desarrollo posterior de la teoría de manera determinante; el segundo aspecto tiene relevancia porque la crítica de Puntel encierra ciertos malentendidos de fondo que desdibujan su propia posición y le impiden tener el alcance que el Prof. Puntel le atribuye. Data involving epistemic modals suggest that some classically valid argument forms, such as _reductio_, are invalid in natural language reasoning as they lead to modal collapses. We adduce further data showing that the classical argument forms governing the existential quantifier are similarly defective, as they lead to a _de re–de dicto_ collapse. We observe a similar problem for disjunction. But if the classical argument forms for negation, disjunction and existential quantification are invalid, what are the correct forms that govern the (...) use of these items? Our diagnosis is that epistemic modals interfere with hypothetical reasoning. We present a modal first-order logic and model theory that characterizes hypothetical reasoning with epistemic modals in a principled manner. One upshot is a sound and complete natural deduction system for reasoning with epistemic modals in first-order logic. (shrink)

Diplomat, bureaucrat, and practical politician, Niccolò Machiavelli served as Second Secretary to the Republic of Florence in the early sixteenth century and became the first major political thinker in the western tradition to make a complete break with the Aristotelian model of politics as a branch of ethics. While _The Prince _is his most famous work, grounding his reputation as the progenitor of "Realpolitik," his many other writings have contributed to a more complex and broader image of the man and (...) his political thought. Thus in recent years Machiavelli has come to be seen as a republican and a proto-liberal by some mainstream political theorists, and as an obfuscator of traditional values and ideologies, including gender roles, by feminists and non-feminists alike. The contributors to this volume, grappling with questions about the position of women in political society, investigate whether or not Machiavelli was truly a misogynist and a proto-fascist or instead a proto-feminist and a democratic republican. Among the themes they explore are the implications of such dichotomies as _Fortuna_ and _virtù_, the public and the private, nature and reason, ends and means, functionality and the common good, as well as the importance of the military to the socialization of citizens, particularly women, to civic life, and the social construction of gender. Some of the contributors even consider the possibility that Machiavelli's approach to ethics provides a special insight that feminists, and women generally, might explore to their benefit. This study investigates priming in an implicit word stem completion (WSC) task by analyzing the effect of linguistic stimuli characteristics on said task. A total of 305 participants performed a WSC task in two phases (study and test). The test phase included 63 unique-solution stems and 63 multiple-solution stems. Analysis revealed that priming (mean = 0.22) was stronger in the case of multiple-solution stems, indicating that they were not a homogeneous group of stimuli. Thus, further analyses were performed only for (...) the data of the unique-solution stems. Correlations between priming and familiarity, frequency of use, and baseline completion were significant. The less familiar words, which were less frequent, had higher priming values. At the same time, the stems with lower baseline completion generated more priming. A regression analysis showed that baseline completion was the only significant predictor of priming, suggesting that the previous processing of the stimuli had a greater impact on the stimuli with low baseline performance. At the same time, baseline completion showed significant positive correlations with familiarity and frequency of use, and a negative correlation with length. When baseline completion was the dependent variable in the regression analysis, the significant variables in the regression were familiarity and length. These results were compared with those obtained in a study using word fragment completion (WFC) by Soler et al. (2009), in which the same words and procedure were employed. Analysis showed that the variables that correlated with priming were the same as in the WSC task, and that completion baseline was the variable that showed the greatest predictive power of priming. This coincidence of results obtained with WFC and WSC tasks highlights the importance of controlling the characteristics of the stimuli used when exploring the nature of priming. (shrink)

Three experiments examined contributions of study phase awareness of word identity to subsequent word-identification priming by manipulating visual attention to words at study. In Experiment 1, word-identification priming was reduced for ignored relative to attended words, even though ignored words were identified sufficiently to produce negative priming in the study phase. Word-identification priming was also reduced after color naming relative to emotional valence rating (Experiment 2) or word reading (Experiment 3), even though an effect of emotional valence upon color naming (...) (Experiment 2) indicated that words were identified at study. Thus, word-identification priming was reduced even when word identification occurred at study. Word-identification priming may depend on awareness of word identity at the time of study. (shrink)

The aim of this paper is to discuss Kripkc?s reasons for declaring the existence of both necessary a posteriori as well as contingent a priori statements, thus breaking the traditional extensional coincidence of the two pairs of concepts:necessary?contingent and a priori?a posteriori. As I shall argue, there is no reason, from Kripke?s work at least, to reject the usual picture of the topic The appeal ot his arguments rests on the ambiguity with which his expressions are used and on the (...) introduction o\ new senses for old notions. This does not mean, however, that all Knpke?s and Putnam?s intuitions on singular terms and natural kind nouns are wrong. Once Kripke?s ideas are properly uudeistood, they are much moreharmless then they are presented to be and they do not pose a threat to traditional relations relations between modal and epistemological categories. Decision support systems, which incorporate artificial intelligence and big data, are receiving significant attention in the public sector. Decision support systems are sociocultural artefacts that are subject to a mix of technical and political choices, and critical investigation of these choices and the rationales they reflect are paramount since they are inscribed into and may cause harm, violate fundamental rights and reproduce negative social patterns. Applying and merging the concepts of sense-making and translation, this article investigates the rationales, translations and (...) critical reflections that shape the development of a decision support system to support social workers assessing referrals concerning child neglect. It presents findings from a qualitative case study conducted in 2019–2020 at the Citizen Centre Children and Young People, Copenhagen Municipality, Denmark. The analysis shows how key actors through processes of translation construct, negotiate and readjust problem definitions, roles, interests, responsibilities and ideas of ambiguity and accountability. Although technological solutionism is present in these processes, it is not the only rationale invested. Rather, technological and data-driven rationales are adjusted to and merged with rationales of efficiency, return on investment and child welfare. Through continuous renegotiation of roles, responsibilities and problems according to these rationales, the key actors attempt to orchestrate ways of managing the complexity facing child welfare services by projecting images of future potentials of the decision support system that are yet to be realised. Interactions with global markets offer development opportunities for Indigenous communities. They also place pressure on the natural resources that communities depend upon for their livelihood and, in many cases, their political and cultural autonomy. These markets often interact with family-based enterprises embedded within commons, with important implications for the social relationships and shared territorial resources that characterise such regimes. In this paper, we analyse the relationships that exist between commons, global markets, and small-scale family enterprises, using the case of mezcal (...) production—an alcoholic beverage made from agave—in an Indigenous community in Oaxaca, Mexico. Most mezcal production is organized at the family level; yet the raw materials and inputs necessary for making mezcal are held communally and regulated by locally-crafted institutions. Empirical data show that as family enterprises engage with an emergent global market for mezcal, the commons become essential for not only protecting territorial resources but also maintaining a degree of autonomy from powerful global markets and value chains. However, this requires substantial investment in monitoring and enforcement, and for community members to value sustainable commons management over short-term economic self-interest. To seek autonomy while participating in global markets, producer families also join together to develop cooperative strategies to access markets on better terms. (shrink)

Concerns about business ethics have led many business schools to integrate ethics into the curriculum, with mixed results (May, Luth, & Schwoerer 2014, Wang & Calvano 2015, Waples, Antes, Murphy, Connelly & Mumford 2009). This paper seeks to improve our understanding of business students’ ethics by looking into their identity, a cognitive lens by which students see themselves and interpret their environment (Triandis 1989) and that can be relatively malleable to priming and socializing processes (Vignoles, Schwartz, & Luyckx 2011, Ybarra (...) & Trafimow 1998). Results show that undergraduate students with higher individual and lower collective identities report lower intentions to behave ethically. Moreover, our results show that a business education has the power to influence students’ ethical intentions by altering their individual and collective identities. Our results suggest that business schools should consider the effects of their curriculum and pedagogies on the development of individual and collective identities to educate more ethical business students. This paper deals with a development of the ancient thought on mimesis in its modern reception as regards a certain idea of theatre. It defends the hypothesis that the figure of the character, as set up in Diderot’s Paradoxe sur le comédien, has its source in a curious reversal of the Platonic mimesis. After presenting the main tenets of Plato’s reflection on mimesis and of Diderot’s theory on character, showing their convergences and contrasts, it is analyzed how such a conceptual (...) turnaround has historically taken place, by establishing a chain of reception from Plato to Diderot passing through Cicero and the Renaissance artists.
